This website is operated by L J L Enterprises Limited, trading as DM Home & Party (“DM Home & Party”, “we”, “us” or “our”). Our online store is hosted by Shopify, which provides the ecommerce platform that enables us to sell our products to you.
These Terms of Service (“Terms”) apply when you visit or use our website, create an account, or purchase products from us. By using our website or placing an order, you agree to these Terms and our Privacy Policy, available at /policies/privacy-policy.
Nothing in these Terms limits or excludes any rights or remedies you may have under the Consumer Guarantees Act 1993, Fair Trading Act 1986, Privacy Act 2020, or any other New Zealand law that cannot legally be limited or excluded.
SECTION 1 — ACCESS AND ACCOUNTS
You must be at least 18 years old to create an account or place an order, or have the permission and supervision of a parent or legal guardian.
You agree to provide accurate, current and complete account, billing, payment and delivery information. You are responsible for keeping your account details and password secure and for activity carried out through your account. Please contact us promptly if you believe your account has been used without permission.
You must not transfer, sell or assign your account to another person.
SECTION 2 — PRODUCTS
We make reasonable efforts to display and describe our products accurately. Product colours and appearance may vary slightly because of lighting, photography, manufacturing batches, screen settings or the device used to view our website. Measurements are approximate unless expressly stated otherwise.
Product availability, descriptions and prices may be changed without notice. We may discontinue a product or limit the quantity available to any customer, address or geographic area.
Any product information or safety instructions supplied with a product must be followed. Products must be used only for their intended purpose and with appropriate adult supervision where relevant.
SECTION 3 — ORDERS
Placing an order is an offer to purchase products from us. An automated order acknowledgement does not necessarily mean that we have accepted your order. Your order is accepted when we confirm acceptance or dispatch the products, whichever occurs first.
We may decline or cancel an order where, for example:
- a product is unavailable;
- there is an obvious pricing or product information error;
- payment cannot be authorised;
- we reasonably suspect fraud, unauthorised resale or misuse; or
- we cannot deliver to the address provided.
If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled item or order using the original payment method, unless another method is agreed with you.
Please check your order carefully before submitting it. Contact us as soon as possible if you want to change or cancel an order. We will try to help, but we may be unable to change or cancel an order after it has been packed or dispatched.
Products sold through the DM Home & Party retail website are intended for personal or household use and not for commercial resale. Business and wholesale purchases may be subject to separate written terms.
SECTION 4 — PRICES AND PAYMENT
Unless clearly stated otherwise, all prices displayed on our New Zealand retail website are in New Zealand dollars and include GST. Delivery charges, if applicable, will be shown at checkout before you complete your order.
Prices, discounts and promotions may change without notice. The price applying to your order is the price shown at checkout when the order is placed, subject to correction of an obvious error.
Physical-store prices and promotions may differ from online prices and promotions. Separate promotion terms apply where provided. If promotion terms conflict with these Terms, the promotion terms apply to that promotion.
You confirm that you are authorised to use the payment method supplied and that the payment information is accurate. Payment must be successfully processed before an order is dispatched.
SECTION 5 — SHIPPING, DELIVERY AND COLLECTION
Available delivery or collection options, charges and estimated timeframes are displayed at checkout or in our Shipping Policy.
Delivery dates and times are estimates unless we expressly agree to a specific date. We will make reasonable efforts to deliver within the stated timeframe and will contact you if we become aware of a significant delay.
We remain responsible for resolving delivery issues as required by New Zealand consumer law. Risk in the products passes to you when the products are delivered to the address you supplied or collected by you or a person authorised by you.
You are responsible for supplying a complete and accurate delivery address and for ensuring that someone can safely receive the order where required. Additional delivery costs caused by an incorrect or incomplete address may be charged to you where permitted by law.
Please contact us promptly if an order is missing, damaged in transit or shows as delivered but cannot be located.
SECTION 6 — RETURNS, REFUNDS AND CONSUMER RIGHTS
Our Refund Policy is available at /policies/refund-policy and forms part of these Terms.
If a product is faulty, unsafe, not of acceptable quality, not fit for its stated or agreed purpose, or does not match its description, you may be entitled to a repair, replacement, refund or other remedy under the Consumer Guarantees Act 1993.
Our change-of-mind return rules are additional to, and do not replace, your rights under New Zealand consumer law. Any exclusions or time limits in our change-of-mind policy do not apply where the Consumer Guarantees Act provides a remedy.

SECTION 7 — INTELLECTUAL PROPERTY
Unless otherwise stated, the text, photographs, graphics, videos, logos, branding, layout and other original content on our website are owned by or licensed to L J L Enterprises Limited and are protected by applicable New Zealand and international intellectual property laws.
You may view and use our website for your own lawful, personal and non-commercial use. You must not copy, reproduce, republish, modify, distribute, scrape, commercially exploit or create derivative works from our content without prior written permission, except where permitted by law.
DM Home & Party names, logos and branding must not be used without our prior written consent. Shopify’s names, logos and branding belong to Shopify or its licensors.
SECTION 8 — THIRD-PARTY SERVICES AND LINKS
Our website may use or link to services operated by third parties, including payment providers, delivery providers, social media platforms and optional Shopify applications.
Third-party websites and services may have their own terms and privacy policies. We are not responsible for content or services supplied independently by third parties, but this does not limit any responsibility we have for your purchase from us under New Zealand law.
SECTION 9 — SHOPIFY
DM Home & Party is powered by Shopify, which enables us to provide our online store. However, products purchased from our store are sold directly by L J L Enterprises Limited, trading as DM Home & Party, and not by Shopify.
Shopify is not the seller of our products and is not responsible for fulfilling our orders. Nothing in this section limits any rights you may have against us under applicable law.
SECTION 10 — PRIVACY
Personal information collected through our website is handled in accordance with our Privacy Policy at /policies/privacy-policy and the Privacy Act 2020.
Because Shopify hosts our store, Shopify and service providers involved in operating the website, processing payments, preventing fraud and delivering orders may process personal information on our behalf. Some information may be processed or stored outside New Zealand. Please see our Privacy Policy for further details.
SECTION 11 — REVIEWS AND FEEDBACK
If you submit a product review, image, suggestion or other feedback, you confirm that you have the right to submit it and that it is accurate, lawful and does not infringe another person’s rights.
You give us a non-exclusive, worldwide, royalty-free licence to use, reproduce, edit and display that feedback for operating and promoting our business. We may moderate or remove feedback that is unlawful, misleading, abusive, offensive, irrelevant or infringes another person’s rights.
We are not required to publish or respond to feedback. We will not disclose personal information contained in feedback except as permitted by our Privacy Policy and applicable law.
SECTION 12 — ERRORS AND AVAILABILITY
We may correct typographical errors, inaccuracies or omissions relating to product descriptions, prices, promotions, delivery charges, transit times or availability.
If an error affects an order already placed, we will contact you and provide any options required by law. We may cancel and refund an order where there is an obvious error and it would be unreasonable to require us to fulfil the order on the incorrect basis.
SECTION 13 — PROHIBITED USE
You must not use our website:
- for any unlawful, fraudulent or malicious purpose;
- to infringe our rights or another person’s rights;
- to submit false, misleading, defamatory, abusive or harmful material;
- to transmit malware or interfere with the website’s operation or security;

- to send spam or unauthorised advertising;
- to impersonate another person or misrepresent your identity;
- to circumvent access, security or purchase limits; or
- to scrape, copy or commercially exploit the website or its content without permission.
We may restrict or suspend access where we reasonably believe these Terms have been breached or where necessary to protect customers, our business or the website.
SECTION 14 — WEBSITE AVAILABILITY AND LIABILITY
We aim to keep our website available, secure and accurate, but do not guarantee that access will always be uninterrupted or error-free. We may suspend or change website features for maintenance, security or operational reasons.
To the maximum extent permitted by law, we are not liable for losses that are indirect, unforeseeable or not caused by our breach of these Terms or applicable law.
Nothing in these Terms excludes or limits:
- rights or remedies under the Consumer Guarantees Act 1993 or Fair Trading Act 1986;
- liability that cannot legally be excluded or limited; or
- liability for fraud, wilful misconduct or personal injury caused by negligence where the law does not permit exclusion.
If products are acquired for business purposes and the parties validly agree in writing to contract out of the Consumer Guarantees Act or relevant provisions of the Fair Trading Act, separate business or wholesale terms will apply.
SECTION 15 — TERMINATION
You may stop using our website at any time. We may suspend or terminate an account or access to the website if you materially breach these Terms, use the website unlawfully, create a security risk, or fail to pay amounts properly due.
Termination does not affect rights or obligations that arose before termination. Provisions that are intended by their nature to continue—including intellectual property, liability, governing law and amounts owed—will continue to apply.
SECTION 16 — SEVERABILITY AND WAIVER
If any provision of these Terms is found to be unlawful or unenforceable, it will be modified or severed only to the extent necessary. The remaining provisions will continue in effect.
If we do not immediately enforce a provision of these Terms, that does not mean we waive our right to enforce it later.
SECTION 17 — CHANGES TO THESE TERMS
We may update these Terms by posting the revised version on this page. Material changes will apply from the effective date stated in the updated Terms and will not remove rights that arose before that date.

SECTION 18 — GOVERNING LAW
These Terms and purchases from our New Zealand retail website are governed by New Zealand law. You and we submit to the non-exclusive jurisdiction of the New Zealand courts.
Nothing in this section prevents a consumer from using any court, tribunal, dispute-resolution service or other remedy available under applicable law.
